A Clark County business is suing after a person allegedly accessed its PayPal account and took nearly $42,000.

Thoroughbred Performance Products, which operates Thoroughbred Diesel on Rockwell Road, filed the suit last week in Clark Circuit Court. 

According to the suit, Thoroughbred officials recently learned a person named Richard Kadamian changed the payment policy on items offered by Thoroughbred through eBay, which directed payments to Kadamian’s PayPal account rather than Thoroughbred’s. The company said it opened the PayPal account because it was required as part of Thoroughbred’s eBay business account.

Kadamian allegedly linked the new policy to 50 items offered by Thoroughbred and kept in stock in Winchester. When customers ordered parts and paid through PayPal, the money was deposited to the other account, Thoroughbred claims. Between March 29 and April 28, the diverted funds totaled $41,950.40, according to the suit.

Kadamian reportedly told eBay officials he had been a business partner with Thoroughbred’s CEO for many years. The company’s only officer, M. Dennis Craig, said he never met Kadamian and he is not affiliated with Thoroughbred.

PayPal also suspended Kadamian’s account, which Thoroughbred believes contains the diverted funds, which have not been released.

Thoroughbred is seeking an order for PayPal not to release the funds until the judge makes a ruling about ownership of the money. Thoroughbred also asks for compensatory and punitive damages and a jury trial.
