A Winchester man agreed to a five-year prison sentence for allegedly assaulting his wife and holding her against her will a year ago.

Nicholas Helmburg of Dubuy Drive pleaded guilty as charged to first-degree unlawful imprisonment, second-degree assault, fourth-degree assault and first-degree strangulation.

According to court documents, Winchester Police were called to the residence on Nov. 2, 2019, after the two got into an argument which went from verbal to physical. Police said the woman was hit on the top of her head and had minor cuts from broken glass after she used a framed picture to defend herself. No weapons were involved.

Prosecutors recommended Helmburg serve one year for unlawful imprisonment, five years for first-degree strangulation, five years for second-degree assault and 12 months for fourth-degree assault. All sentences would run concurrently.

Helmburg’s sentencing hearing was scheduled for Dec. 10.

Thursday, Clark Circuit Judge Jeff Walson denied a motion to remove Helmburg from home incarceration and an ankle monitor.
