Results from Stuff hearing to be shared at BOA meeting

After three hours of testimony, questions and an occasional outburst from the audience Thursday night, a decision about Stuff Recycling and its property use will wait until another day.

The Winchester-Clark County Board of Adjustments met in special session Thursday for a public hearing on a complaint that the business has violated the terms of its zoning. The business presently occupies 10 acres on U.S. 60 near the Clark-Fayette county line.

At the end of the hearing, the board members voted unanimously to close the hearing and public comment period. In order to allow time to read the documentation and exhibits offered, a decision was postponed to a future Board of Adjustments meeting. The board’s next regular meeting is Oct. 4 at Winchester City Hall.

A 2012 decision by the board grandfathered the use of approximately seven of the business’ nine acres at the time for recycling use, provided it remain behind the front of the buildings on the site.

“There’s no question the business has expanded…” resident Tresa Bridges said. “You can’t enjoy your home. You can see the piles of metal over the fence.”

Bridges, who lives nearby on Clintonville Road, filed the complaint with the board of adjustments after a fire at Stuff in June.

Bridges said the business has expanded through growth and in size after it purchased an additional acre of property.

Stuff owner Jerry Joiner did not deny the business has grown, but said the recycling operation remained on the back of the property behind all buildings, as the 2012 decision required.

“The footprint has not grown,” Joiner said. “The volume has.”
