Court seeks records for competency ruling
Court officials want more information before determining whether a Clark County man can be tried for trying to lure a minor into a sexual performance.
Charles Tackett, 71, of 31 E. Washington St., was arrested in July on an indictment warrant for two counts of attempted use of a minor in a sexual performance and one count of first-degree persistent felony offender.
Tackett had a competency hearing Friday morning in Clark Circuit Court. According to court documents, Clark Circuit Judge Brandy Oliver Brown took the matter under advisement but wanted additional medical records.
Another court date was not scheduled.
The indictment did not list specific dates for the alleged incidents, but claimed he twice tried to “induce a minor younger than 16” into a sexual performance in the spring of 2018.
The indictment also said Tackett is a convicted sex offender, citing convictions in Fayette County for possession of matter portraying a sexual performance by a minor in 2013, third-degree sodomy in 2002 and first-degree criminal mischief in 1995.
If convicted, Tackett could be sentenced to five to 10 years in prison. A PFO conviction would increase the sentence range to 10 to 20 years.
Tackett remains in the Clark County Detention Center on a $20,000 bond.
