Most charges in deputy assault dismissed

Most of the charges against a man accused of assaulting a Clark County deputy sheriff have been dismissed.
Justin Wayne Bailey, 32, was arrested in September 2020 on a number of charges following an incident on Combs Ferry Road.
According to court officials, Bailey pleaded guilty on Jan. 25 to a single count of possession of marijuana, and was sentenced to two days in jail.
The remaining charges, including third-degree assault, driving under the influence, first-degree fleeing or evading police, menacing and resisting arrest, were all dismissed by the presiding judge.
According to court documents, deputies were called to Combs Ferry Road on Sept. 12, 2020, concerning a man and woman fighting in a church parking lot.
When Deputy Colton Lewis arrived, he said he saw a man, later identified as Bailey, trying to start a pickup truck. Lewis said the man refused to show his hands, did not respond to other commands and confronted Lewis multiple times.
Bailey was arrested, and Lewis said he found two bags of marijuana in the truck.
